Consent and Waiver

Individuals volunteering for Plant It Forward Farms (“PIFF”) are asked to consider and evaluate carefully the risks associated with manual labor and the waivers and agreements set forth in this form. Individuals are advised to discuss and review thoroughly all such risks, waivers and agreements with their legal or other advisors as they deem appropriate. Individuals are reminded that volunteering for PIFF is completely voluntary and, as such, is not required.

Individuals who elect to volunteer for PIFF must review and complete the following Consent and Waiver (this “Agreement”).

Agreement.

The undersigned individual (the “Volunteer”) hereby acknowledges, consents and agrees to the following terms and conditions associated with the Volunteer engaging in the activities related to being a volunteer for PIFF.

1. Assumption of Risk: Volunteer understands and acknowledges that there are risks of injury and damage related to the Volunteer’s participation in activities relating to being a volunteer for PIFF. Some of these risks are known and some are unknown or anticipated and can include property damage and serious physical or mental injury or death. Volunteer understands that such risks are an inherent part of volunteering for PIFF and cannot be fully eliminated. Volunteer acknowledges that the Volunteer’s participation in the activities related to being a volunteer for PIFF is voluntary and that such participation is not a requirement. Volunteer hereby assumes the risk of any bodily injury or property loss or damage associated with the Volunteer’s participation in the activities related to being a volunteer for PIFF.

2. Release and Covenant Not to Sue: Volunteer hereby (a) releases and waives any and all claims or causes of action Volunteer may have now or in the future against PIFF, its officers, directors, partners, employees, agents and authorized representatives (collectively, the “Released Parties”) for injuries, damages, losses or expenses arising out of or in connection with the Volunteer’s participation in the activities related to being a volunteer for PIFF, whether known or unknown, whether arising in tort, contract or otherwise, whether foreseeable or unforeseeable (collectively, the “Losses”); and (b) covenants and agrees not to sue any of the Released Parties in connection with any such Losses.

3. Indemnity: Volunteer hereby agrees to indemnify and hold harmless the Released Parties from any and all claims or causes of action related to the Farmer’s participation in the activities related to being a volunteer for PIFF.

4. Promotional Consent: Volunteer hereby irrevocably consents to the use of Volunteer’s image (by means of photograph or any other likeness of Volunteer), voice and name, either in whole or in part and in any and every form, style, size or color, and any related biographical material of Volunteer, edited as PIFF may deem appropriate, by PIFF and its agents, licensees, nominees, affiliates, successors and assigns (including print, broadcast, television, radio, electronic (including Internet), outdoor (including billboards) and any other advertising media now in existence or hereafter created), for
advertising, publicity, business, trade or art purposes or any other purpose. Volunteer agrees that Volunteer’s image may be used either alone and/or in conjunction with sketches, cartoons, captions, films, artwork, textual matter or other photographs. PIFF will have all rights to register copyrights and renewals thereof in all materials utilized by PIFF pursuant to this Agreement. Volunteer understands that Volunteer will receive no payments or royalties. The consideration for Volunteer’s signing this Agreement is the promotional value that Volunteer may receive from PIFF’s promotional campaign. PIFF will not be required to use Volunteer’s image, voice or name for any minimum amount of advertising.

5. Severability: If any provision of this Agreement or the application thereof to any person or circumstance shall to any extent be held to be invalid or unenforceable, then the remainder of this Agreement shall not be affected thereby and each provision of this Agreement shall be valid and enforceable to the fullest extent permitted by law.

6. Certification: Volunteer hereby certifies that Volunteer has read this Agreement in its entirety, that Volunteer understands the terms and provisions hereof, and that Volunteer agrees to be bound hereby. Volunteer further covenants and agrees that Volunteer will not challenge the enforceability of all or any portion of this Agreement.
